Accommodation contracts and related agreements concluded between this hotel and guests shall be subject to the provisions of these terms and conditions, and any matters not provided for in these terms and conditions shall be governed by laws and regulations or generally accepted practices. In the event that this hotel accepts a special contract within the scope of laws and regulations and generally accepted practices, the special contract shall take precedence, notwithstanding the provisions of the preceding paragraph.
A person who intends to apply for an accommodation contract with the Hotel shall notify the Hotel of the following particulars:
In the event that a Guest requests, during his/her stay, to extend his/her stay beyond the date specified in subparagraph (2) of the preceding paragraph, the Hotel shall treat such request as if it were an application for a new Accommodation Contract at the time such request was made.
An accommodation contract shall be deemed to have been established when the Hotel accepts the application as stipulated in the preceding Article. However, this shall not apply when the Hotel proves that it has not accepted the application.
When an accommodation contract has been concluded in accordance with the provisions of the preceding paragraph, the application fee specified by the Hotel shall be paid by the date designated by the Hotel, up to the basic accommodation fee for the period of stay (3 days if the period of stay exceeds 3 days). I'll enjoy having this.
The application fee will first be applied to the accommodation fee that the guest will ultimately have to pay, and in the event that the provisions of Articles 6 and 18 apply, the application fee will be applied to the cancellation fee and then to the compensation. If there is any remaining amount, it will be returned at the time of payment of fees pursuant to Article 12.
If the application fee set forth in Paragraph 2 is not paid by the date specified by the Hotel pursuant to the provisions of the same Paragraph, the Accommodation Contract shall become invalid, provided, however, that the Hotel has so notified the Guest when specifying the due date for payment of the application fee.
Notwithstanding the provisions of Paragraph 2 of the preceding Article, the Hotel may enter into a special contract that does not require the payment of the deposit as stipulated in the same Paragraph after the conclusion of the contract.
In the event that the Hotel has not requested the payment of the application fee stipulated in Paragraph 2 of the preceding Article and/or has not specified the date by which the application fee is to be paid at the time the Hotel accepts the application for an Accommodation Contract, it shall be treated as having accepted a special contract as stipulated in the preceding Paragraph.
The hotel may not accept the conclusion of an accommodation contract in the following cases.
The Guest may cancel the Accommodation Contract by notifying the Hotel.
In the event that the Guest cancels the Accommodation Contract in whole or in part due to reasons attributable to the Guest (except in the event that the Hotel has requested payment of the application fee by specifying a due date pursuant to the provisions of Article 3, Paragraph 2 and the Guest cancels the Accommodation Contract prior to such payment), the Hotel shall charge a penalty as listed in Attached Table 2. However, in the event that the Hotel has accepted a special contract as set forth in Article 4, Paragraph 1, this shall apply only when the Hotel has notified the Guest of the obligation to pay the penalty in the event that the Guest cancels the Accommodation Contract, in accepting such special contract.
If the Guest does not arrive by 6:2 p.m. on the day of accommodation without contacting the Hotel (or by two hours after the expected arrival time if the Guest has specified such time in advance), the Hotel may regard the Accommodation Contract as having been cancelled by the Guest.
The hotel may cancel the accommodation contract in the following cases.
When the hotel has canceled the accommodation contract in accordance with the provisions of the preceding paragraph, the guest will not be charged for the accommodation services, etc. that have not yet been provided.
The Guest shall register the following particulars at the front desk of the Hotel on the day of accommodation.
If the Guest intends to pay the charges set forth in Article 12 using a method that can be substituted for currency, such as a traveler's check, accommodation voucher, or credit card, the Guest must present these in advance at the time of registration as set forth in the preceding paragraph.
The hours during which a Guest may occupy a guest room at the Hotel shall be as follows: However, in the case of consecutive stays, the Guest may occupy the room all day, except on the days of arrival and departure.
Notwithstanding the provisions of the preceding paragraph, the Hotel may permit the Guest to occupy the room outside the hours specified in the same paragraph. In such cases, the following additional charges will be charged.
The amount equivalent to the room charge in the preceding paragraph shall be 70% of the basic accommodation charge.
Guests are required to observe the Hotel Usage Regulations established by the Hotel and posted within the premises of the Hotel.
The opening hours of the main facilities of the Hotel are as follows. Detailed opening hours of other facilities will be provided in the pamphlets provided, on notices posted in various locations, in the service directory in the guest rooms, etc.
The breakdown of the accommodation charges, etc. to be paid by the guest shall be as listed in Appended Table XNUMX.
The accommodation charges, etc. referred to in the preceding Paragraph shall be paid in Japanese currency or by any other means acceptable to the Hotel, such as travellers' cheques, accommodation coupons or credit cards, at the time of the Guest's departure or upon request by the Hotel.
Accommodation charges shall be charged even if the guest voluntarily does not stay after the hotel has provided a guest room to the guest and it has become available for use.
The Hotel shall compensate the Guest for damages caused to the Guest in the fulfillment or nonfulfillment of the Accommodation Contract and/or related agreements, unless such damages have been caused by reasons beyond the Hotel's control.
Although our hotel has received the fire service mark from the fire department, we have ryokan liability insurance in order to deal with the unlikely event of a fire.
When the Hotel is unable to provide a contracted room to a Guest, it will arrange accommodation of the same standards elsewhere for the Guest, with the Guest's consent, wherever possible.
Notwithstanding the provisions of the preceding paragraph, if the Hotel is unable to arrange other accommodation for the Guest, the Hotel shall pay the Guest a compensation fee equivalent to the penalty charges, which shall be applied to the amount of damages. However, if the Hotel is unable to provide a room due to reasons beyond the Hotel's control, the Hotel shall not pay a compensation fee.
In the event that loss, breakage or other damage occurs to goods, cash or valuables deposited by the guest at the front desk, the hotel will compensate for such damage, unless this is due to force majeure. However, in the case of cash and valuables, if the hotel requests the guest to disclose the type and value of the items and the guest fails to do so, the hotel will compensate for such damage up to a maximum of 15 yen.
The Hotel shall compensate for damages incurred when loss, breakage or other damage occurs due to the Hotel's willful misconduct or negligence with respect to goods, cash or valuables brought into the Hotel by a Guest but not deposited at the Front Desk. However, for items for which the Guest has not previously notified the Hotel of the type and value, the Hotel shall compensate for such damages up to a maximum of 15 yen, except in cases where the damage is due to the Hotel's willful misconduct or gross negligence.
If the guest's baggage arrives at the hotel prior to their stay, the hotel will take responsibility for keeping it only when the hotel agrees prior to arrival, and will hand it over to the guest when he or she checks in at the front desk.
If a guest's baggage or belongings are found left behind at the hotel after check-out, and the owner is identified, the hotel will contact the owner and ask for further instructions. However, if there is no instruction from the owner or the owner is not identified, the hotel will store the item for seven days, including the day it was found, and then deliver it to the nearest police station.
In the case of the preceding two paragraphs, the hotel's liability for the custody of the guest's baggage or belongings shall be in accordance with the provisions of paragraph 2 of the preceding article in the case of paragraph 1, and The provisions of paragraph 1 shall apply.
When a Guest uses the parking lot of the Hotel, regardless of whether or not the vehicle key is deposited, the Hotel only lends the space and does not assume responsibility for the management of the vehicle. However, if damage is caused intentionally or negligently on the part of the Hotel in managing the parking lot, the Hotel shall be responsible for compensation.
In the event that the Hotel suffers damage intentionally or negligently on the part of the Guest, the Guest shall compensate the Hotel for the damage.
